1. Agreement and operator
These Terms of Use (the “Terms”) are an agreement between you and Three Olives Creative LLC(“we,” “us,” or “our”), the developer and licensor of Portsmith. They apply when you access portsmith.app, download or use Portsmith, start a trial, or purchase a license.
You must be legally able to enter a binding agreement. If you use a product for an organization, you confirm that you have authority to bind that organization. If you do not agree to these Terms, do not use the website or software.
2. Products and current availability
Portsmith is a native macOS utility that inspects local listening ports and related process metadata and offers local process actions. Its current system requirements and functionality are described on the purchase and download surfaces presented before checkout.
Agent Island is not offered for sale as a separate product. Its agent-session monitoring functionality is included in Portsmith and is covered by every Portsmith trial and license at no additional charge. The standalone Agent Island build is a retired preview that receives no further updates and may be withdrawn. The existence of a frozen preview download or update artifact does not create a separate commercial offer.
3. Trial, purchase, and delivery
Portsmith includes a three-day local trial that begins only when you select “Start Trial.” Buying Portsmith is a one-time purchase, not a subscription. You are responsible for confirming compatibility during the trial and providing an accurate email address at checkout so we can deliver and support your license key.
Lemon Squeezy acts as merchant of record and legal seller for checkout. Its terms govern payment processing, tax, receipts, fraud review, chargebacks, and any transaction-level action it must take. Review the Lemon Squeezy Buyer Terms before purchasing.
4. Software license
After valid payment and delivery of a license key, we grant the purchaser a limited, non-exclusive, non-transferable license to install and use the purchased product for personal or internal business purposes on devices the purchaser owns or controls, subject to the checkout description and these Terms. The license is a right to use the software; ownership of the software and its intellectual property does not transfer to you.
Do not publish, sell, sublicense, rent, or share a license key; use a key to provide a competing hosted or managed service; or bypass the trial, license verification, or safety controls. You may not copy, modify, reverse engineer, decompile, or attempt to derive source code except to the limited extent applicable law expressly permits despite this restriction.
5. Updates and product changes
A valid license includes, at no additional charge, any updates to the same product that we generally release and make available. Updates are signed and distributed through the product’s update mechanism or official download location.
We do not promise a particular update schedule, specific future features, perpetual development, or compatibility with every future macOS release, except where applicable law requires otherwise. We may add, change, remove, suspend, or discontinue functionality, while honoring non-waivable legal obligations.
6. Responsible use
Use the products only on computers and processes you are authorized to inspect or manage. Process termination can interrupt work or cause data loss. Review the target and confirmation shown by Portsmith before taking an action, and maintain appropriate backups.
You may not use the website or products unlawfully, to harm another person or system, to distribute malware, to interfere with service operation, or to violate another person’s privacy, security, or intellectual-property rights.
7. Privacy
Our Privacy Policy explains how website, checkout, support, update, and on-device information is handled. The desktop products are local-first and do not include our own analytics or telemetry SDKs.
8. Final sales and refunds
We do not offer voluntary or change-of-mind refunds, credits, or exchanges. All sales are final, subject to the non-waivable rights and remedies available under applicable law and any action Lemon Squeezy takes as merchant of record under its buyer terms and policies.

9. Third-party services and components
The website and products rely on third-party infrastructure and open-source components, including Apple platform services, Vercel hosting, Lemon Squeezy checkout, and Sparkle updates. Those providers may apply their own terms and privacy policies. We are not responsible for a third party’s independent service, outage, or policy.
10. “As is” software and warranties
To the maximum extent permitted by applicable law, the website, Portsmith, the retired standalone Agent Island preview, and related materials are provided “as is” and “as available,” with all faults and without express or implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the software will be error-free, uninterrupted, or suitable for every workflow.
Nothing in these Terms excludes, restricts, or modifies any warranty, consumer guarantee, remedy, or liability that cannot lawfully be excluded, restricted, or modified.
11. Limitation of liability
To the maximum extent permitted by law, Three Olives Creative LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption arising from the website or products.
To the maximum extent permitted by law, our total liability for claims relating to a purchased product will not exceed the amount you paid for that product. These limits do not apply where liability cannot legally be limited, including any non-waivable consumer protection or liability for fraud or willful misconduct.
12. Suspension and termination
You may stop using a product at any time. We may suspend website access or terminate a license for material breach of these Terms, including unauthorized distribution of a license key. Sections that by their nature should survive termination—including ownership, warranty disclaimers, liability limits, and payment obligations—will survive.
13. Changes and general terms
We may revise these Terms as products or legal requirements change. The updated page will show its effective date. Material changes apply prospectively unless law requires otherwise. Continued use after an updated effective date constitutes acceptance where permitted by law.
If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, Refund Policy, and applicable checkout terms form the agreement for the website and purchased software.
